Plain Language Summary

These Terms govern your use of Kubo. The key points: you must be 18+, you're responsible for your content and conduct, we can terminate accounts that violate our rules, and disputes are resolved through arbitration. Please read the full terms below.

1. Agreement to Terms

By creating an account or using Kubo (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use Kubo.

These Terms constitute a legally binding agreement between you and Kubo Dating LLC, a New York limited liability company ("Kubo," "we," "us," or "our").

2. Eligibility

2.1 Age Requirement

18+ Only

You must be at least 18 years old to use Kubo. By creating an account, you represent and warrant that you are 18 years of age or older. We will terminate accounts of users we discover to be under 18.

2.2 Additional Requirements

To use Kubo, you must:

Be capable of forming a binding contract
Not be prohibited from using the Service under applicable law
Not have been previously banned from Kubo
Not be required to register as a sex offender

3. Your Account

3.1 Account Creation

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 One Account Per Person

You may only create and maintain one account. Creating multiple accounts may result in termination of all accounts.

3.3 Account Security

You must immediately notify us at security@kubo.so if you believe your account has been compromised.

4. User Conduct & Content

4.1 Your Content

You are solely responsible for the content you post, including photos, messages, and profile information ("User Content"). By posting User Content, you represent that:

You own the content or have the right to share it
The content does not infringe any third party's rights
The content complies with these Terms and applicable law

4.2 License to Your Content

By posting User Content, you grant Kubo a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content solely for operating and improving the Service. This license ends when you delete your content or account, except for content shared with other users (which may persist in their message history).

4.3 Prohibited Content & Conduct

You agree NOT to:

Post illegal content including child sexual abuse material (CSAM), non-consensual intimate images, or content that facilitates human trafficking
Harass, threaten, or abuse other users
Impersonate another person or create fake/misleading profiles
Spam or solicit other users for commercial purposes
Scam or defraud other users (romance scams, money requests, etc.)
Share others' private information without consent
Circumvent any security measures or access restrictions
Use bots, scrapers, or automation without written permission
Interfere with the Service's operation or other users' experience

Zero Tolerance for CSAM

Kubo has zero tolerance for child sexual abuse material. We use PhotoDNA and similar technologies to detect CSAM. All detected or reported CSAM is reported to the National Center for Missing & Exploited Children (NCMEC) as required by law. Accounts posting CSAM are immediately and permanently terminated.

4.4 Content Moderation

We reserve the right to remove content that violates these Terms or that we determine, in our sole discretion, is harmful or inappropriate. We may also report illegal content to law enforcement.

5. Safety & Reporting

5.1 Your Safety

Kubo provides tools to help you stay safe, but you are responsible for your own safety when meeting people from the Service. We recommend:

Meeting in public places for initial encounters
Telling someone you trust about your plans
Not sharing financial information or sending money
Trusting your instincts and leaving if uncomfortable

5.2 Reporting

If you encounter content or behavior that violates these Terms, please report it using the in-app reporting feature or contact safety@kubo.so.

5.3 No Background Checks

Important Disclosure

Kubo does not conduct criminal background checks on users. We do not verify users' identities, backgrounds, or statements. You should exercise caution and good judgment when interacting with other users.

6. Subscriptions & Payments

6.1 Free & Premium Tiers

Kubo offers a free tier with full functionality and a Premium subscription with additional convenience features. See our Pricing page for details.

6.2 Payment Processing

All payments are processed through Apple (App Store) or Google (Play Store). Your purchase is subject to their respective terms and conditions.

6.3 Subscription Renewal

Premium subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage subscriptions through your device's app store settings.

6.4 Refunds

Refunds are handled by Apple or Google according to their policies. Kubo does not directly process refunds.

6.5 California Residents

3-Day Cancellation Right

Under California Civil Code §§ 1694-1694.4, California residents may cancel a dating service contract within 3 business days of the date you sign the contract and receive a full refund. To cancel, contact Apple or Google through their refund process within this period.

7. Our Commitments to You

            What We Promise
            Privacy features stay free: Incognito mode, location fuzzing, and expiring photos will always be free
No data selling: We will never sell your personal data to third parties
Fair visibility: Everyone gets equal visibility regardless of subscription status
Fair moderation: If you're banned, you'll know why and have an appeals process
Transparent pricing: We won't exploit you with manipulative pricing

        

8. Account Suspension & Termination

8.1 Our Right to Terminate

We may suspend or terminate your account at any time for:

Violation of these Terms
Conduct harmful to other users, Kubo, or third parties
Creation of legal liability for Kubo
Extended inactivity (accounts inactive for 2+ years)

8.2 Fair Moderation Process

Consistent with our commitment to transparency:

You will be notified of the reason for suspension or termination
You may appeal by contacting appeals@kubo.so
Appeals are reviewed by a human within 5 business days
We will reinstate accounts terminated in error

Exception: Accounts terminated for CSAM, threats of violence, or other severe violations are not eligible for appeal.

8.3 Your Right to Terminate

You may delete your account at any time through the app settings. Upon deletion:

Your profile is immediately hidden from other users
Your data is retained for 30 days (for account recovery)
After 30 days, your data is permanently deleted (except as required by law)

9. Intellectual Property

9.1 Our Property

The Kubo name, logo, and all software, design, text, and graphics comprising the Service are owned by Kubo Dating LLC or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

9.2 Feedback

If you provide suggestions or feedback about Kubo, you grant us an unlimited, irrevocable, royalty-free license to use such feedback without compensation to you.

10. Disclaimers

10.1 "As Is" Service

No Warranties

KUBO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10.2 No Guarantees About Users

We do not guarantee the accuracy of users' profiles, statements, or representations. We do not screen users for criminal history, verify identities, or confirm relationship status. You assume all risk when communicating with or meeting other users.

10.3 Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third parties.

11. Limitation of Liability

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUBO DATING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO KUBO IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kubo Dating LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of:

Your use of the Service
Your User Content
Your violation of these Terms
Your violation of any third party's rights

13. Dispute Resolution & Arbitration

13.1 Informal Resolution First

Before filing any claim, you agree to contact us at legal@kubo.so and attempt to resolve the dispute informally for at least 30 days.

13.2 Binding Arbitration

Arbitration Agreement

If we cannot resolve the dispute informally, you and Kubo agree to resolve any disputes through binding individual arbitration, except for claims that may be brought in small claims court. Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules.

13.3 Class Action Waiver

YOU AND KUBO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

13.4 Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in court for intellectual property infringement or unauthorized use of the Service.

13.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@kubo.so within 30 days of first accepting these Terms. The notice must include your name, address, and a statement that you wish to opt out.

14. Governing Law

These Terms are governed by the laws of the State of New York without regard to conflict of law principles. Any claims not subject to arbitration shall be brought exclusively in the state or federal courts located in New York County, New York.

15. Changes to Terms

We may update these Terms from time to time. When we make material changes:

We will update the "Last Updated" date at the top
We will notify you in-app or via email at least 30 days before changes take effect
Your continued use after changes take effect constitutes acceptance
If you disagree with changes, you may delete your account

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kubo regarding the Service.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16.3 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

16.4 Assignment

You may not assign your rights under these Terms. Kubo may assign its rights to any affiliate or successor.

16.5 Force Majeure

Kubo is not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.
